It is important that you read these Terms & Conditions before using SwapShop. By accessing the SwapShop website or using the SwapShop service, you agree to be bound by these terms and conditions.

The SwapShop site is owned and operated by Swapsites Limited whose registered office is Unit 45 Rissington Business Park, Upper Rissington, Nr Cheltenham, Gloucestershire, GL54 2QB

At our discretion, these terms and conditions may be amended from time to time. Notice of any changes will be posted on the SwapShop website.

These Conditions shall be governed by and interpreted in accordance with English law and the courts of England shall have exclusive jurisdiction to hear all disputes arising in connection with these terms and conditions.

1. You must register as a member in order to use the SwapShop site and its services and by registering as a member you agree to be bound by these terms and conditions.

2. You must be 18 years old or over in order to register and to use the SwapShop site.

3. SwapShop will review all member registration and reserves the right to reject any registration at its sole discretion.

4. In order to let you trade on SwapShop we require certain information about you. You must provide full and accurate information. If you provide false or inaccurate details when registering as a member we may revoke your membership without notice.

5. You must update your registration details should they change at any time.

6. SwapShop do offer a trading guarantee, however, all items on SwapShop are owned by third parties or SwapShop members. SwapShop never possess the items offered on the website and, therefore, we have no control over the legality, safety and or quality of the items offered.

7. SwapShop is not responsible for making sure that senders and receivers complete transactions. Should there be any problem with a transaction or SwapShop Member the quickest and best route to resolve the issue is to email the member using the contact links on the SwapShop site and swap transaction emails. Should any dispute not be resolved satisfactorily, please let us know by filling in the feedback form

8. The number of Swap Points allocated to an item are calculated at what we consider is a fair market value based on its availability as a pre-owned product. You will be informed of the number of Swap Points an item is worth when you list it, however, we will change the number of Swap Points that listed items are worth to track what we consider to be a fair market value. We will inform you of the number of Swap Points that your item will receive when you are asked to confirm that you want to swap an item you have listed.

9. You must not use SwapShop to trade any items that:

Are damaged or not fit for purpose, for example, this includes, but is not limited to, unplayable DVDs, any counterfeit items, books with pages missing or loose, DVD sets with discs missing or incorrect discs.
Are stolen, counterfeit or fraudulent
Infringe any third party’s copyright, patent, trade mark, trade secret or other proprietary rights.
Are obscene or contain material which is or may be indecent
Are illegal or may cause SwapShop to breach any applicable laws.
You are not legally able to trade

10. SwapShop reserve the right to remove any item listed at its sole discretion and without notice.

11. When an item you have listed is requested by another member we will send you an email and you can confirm or reject the offer to trade the item. You must do this within four days of receiving (96 hours) of the item being requested. If you do not confirm or reject the offer within this timeframe, it will then be reviewed by SwapShop and we will cancel the offer.

12. If you confirm the request to trade an item you then enter into a contract with the requesting member and you agree to fulfil your obligations as a sender. You will need to, within three working days, dispatch the item described in your listing to the name and address listed at the address provided in the confirmation email. You must make sure that the item is adequately packaged, clearly and properly addressed and that the correct postage is used to fully cover the delivery of the item. You are advised to obtain a certificate of posting (available for free from the post office), this will enable you to claim compensation from the Royal Mail (currently up to 100 times the cost of a first class stamp), if your item is lost in transit.

13. When you receive an item you must confirm receipt of the item on the SwapShop site as soon as possible.

14. Should you receive an item that is counterfeit, missing a disc, unplayable, missing pages or generally unusable then you will be eligible for recourse under our trading guarantee. You must contact us within 14 days of receipt of an item in order to be eligible for this trading guarantee.

15. You must first contact the sender in order to resolve the issue. If the issue cannot be resolved and you have a legitimate claim, then tell us as soon as possible by filling in the feedback form at www.swapshop.co.uk/feedback. We will ask you to send the item to us so we can verify its condition and should your claim be upheld we will reimburse you with the appropriate amount of swap points.

16. Senders who send counterfeit, unplayable, or generally unfit for purpose items will have their account at SwapShop terminated at our sole discretion.

17. Swap points generated from the trading of items and swap points received by purchasing points will be held on the SwapShop system and are not transferable or redeemable outside of the SwapShop site.

18. Swap points will be added to a members account upon the successful receipt and confirmation of receipt by the SwapShop member who requested the item.

19. Swap Points will be deducted from a members account when they request an item from another SwapShop member.

20. Without limiting our other remedies, we may limit your activity on this site, immediately issue a warning, suspend or terminate your membership or any of your listings and refuse to provide our services to you without notice to you if: (a) you breach these terms and conditions; or (b) we believe your actions may cause us financial loss or legal liability.

21. SwapShop reserves the right to cease operating the website or to terminate your access and use of any part of the website at any time by giving written notice, which will be given by email.

22. If we or you terminate your membership (for any reason), you are not entitled to any compensation including compensation for any unused Swap Points.
